  • If your real property was foreclosed and sold in a sheriff sale by the City of Philadelphia (“City”), you may be a class member in a class action against the City.
  • A settlement has been reached in the case Butterline v. City of Philadelphia, No. 2:15-cv-01429-JS (E.D. Pa), entitling eligible Settlement Class Members who make a claim to excess proceeds from the sheriff sale that were not returned.
  • The Notice explains: 1) the terms of the Settlement; 2) who is a member of the Class; 3) how to submit a claim for payment; 4) how to request exclusion from the Settlement; 5) how to object to the Settlement; and 6) how to get more information about the Settlement.

Do It
Do Nothing You have the right to do nothing. If you do nothing, you will be bound by the terms of the Settlement and will release any claim against the City for excess proceeds, even if you do not submit a Claim for payment. In other words, if you do nothing, you will give up your right to sue the City and receive nothing in return. None
Submit a Claim Form. You may submit a Claim Form for payment of your excess proceeds. If you received a Notice in the mail, the Notice included a pre-filled Claim Form. You can submit a claim by filling and signing the Claim Form and putting the Claim Form in the mail by the deadline.

Exclude Yourself from the Settlement You have the right to not be part of the Settlement by excluding yourself or “opting out” of the Class. If you wish to exclude yourself, you must do so on or before August 23, 2022 as described in the Notice. Postmarked on or before August 23, 2022
Object to the Settlement If you think the terms of the Settlement are not fair, reasonable, or adequate to the Class Members, you can file a Notice of Intent to object to the terms of the Settlement. If you object to the terms of the Settlement, you cannot request exclusion from the Settlement. Instructions on how to object can be found in the Notice. Postmarked on or before August 23, 2022
